For hosting and maintenance, we recommend our own Elite Concierge VPS Hosting, Servers, and Maintenance Plan, which is a powerful solution. However, we are very agile and will certainly mold to your preferences. If you prefer another hosting service like GoDaddy, or HostGator, et al., please let us know. We are also trained and fluent with those services offered by Amazon (AWs) and Google.

1. Authorization

You are engaging Websitie, as an independent contractor for the services of website development, deployment, hosting (tbd), & support.

2. Payment

Fees to Websitie are due in accordance with the above listed milestones section.

3. Completion

We must work together to complete the project in a timely manner. Websitie agrees to work expeditiously to complete the project no later than the date specified in the timeline of this proposal (depending on the date of acceptance of the agreement).

4. Assignment of Project

Websitie reserves the right to assign subcontractors to this project to ensure the right fit for the job as well as on-time completion.

5. Revision During Execution

Please note that you may be charged additional fees (negotiable, of course) if you decide to make changes to the agreed upon project scope and objectives.

6. Legal & License

Websitie warrants that the functionality contained in this project will meet all of your requirements and that the operation will be reasonably error-free.

The entire risk as to the quality and performance of the project is with you. In no event will Websitie be liable to you or any third party for any damages, including any lost profits, lost savings, or other incidental, consequential or special damages arising out of the operation of or inability to operate the website, even if Websitie has been advised of the possibility of such damages.

If any provision of this agreement shall be unlawful, void, or for any reason is unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

7. Copyrights & Trademarks

You are representing to Websitie and unconditionally guarantee that any elements furnished to Websitie for inclusion in the project are owned by you or the company that you represent, or that you have legal permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Websitie and its subcontractors from any claim or suit arising from the use of such elements furnished by you .

8. Copyright to Project

Websitie guarantees that all aspects of design and construction of the project will be disclosed to you upon completion, and full code, copyrights, and ownership will be the sole property of yourself or the company that you represent. Websitie retains the right to display graphics and other design elements as examples of its work in its portfolio.

9. Sole Agreement

The agreement contained in this Contract constitutes the sole agreement between Websitie and you regarding this project. Any additional work not specified in this contract must be authorized by a written change order. All prices specified in this contract will be honored for three (3) months after both parties sign this contract. Continued services after that time will require a new agreement.

10. Initial Payment & Refund Policy

If you halt work and apply for a refund within 4 days, work completed shall be billed at the hourly rate of $100 per hour, and deducted from the initial payment, the balance of which shall be returned to you. If at the time of the request for a refund, work has been completed beyond the amount covered by the initial milestone payment, you shall be liable to pay for all work completed at the hourly rate stated above.

The first milestone, 'Project Start' is due upon the start of this contract.

11. Ongoing and other fees

Hosting, maintenance, upkeep, and third-party fees which may be needed for your project are not included in the cost estimate for this proposal. For hosting, we strongly recommend our own powerful hosting and VPS (Virtual Private Server) solution as it is all-inclusive and capable of taking care of thousands of users simultaneously. It is also easily scalable and handled by onboard seasoned developers and designers.
